Court Upholds IRS Authority to Charge PTIN Fees

 
A federal appeals court has upheld the IRS’s authority to charge a fee for tax preparers obtaining and renewing a PTIN. The court determined that the IRS provides a specific service to tax return preparers in exchange for the PTIN fee - it allows preparers to use their PTIN rather than their SSN on tax returns, thereby protecting the SSN.
